What if a publisher objects to the Rights Retention statement?

Many universities have adopted Rights Retention strategies and there has been little push back from publishers. It is very unlikely a journal will refuse to publish because you include the Rights Retention Statement in your manuscript. 

Leeds Beckett have written to over 200 of the journal publishers our authors most frequently publish with to give them prior notification of our policy, and this has been accepted by the vast majority of publishers.

The Rights Retention approach is legal in UK copyright law through the mechanism of prior notice (or ‘carve out’) whereby the non-exclusive retention of rights is not nulled by the subsequent assignment of copyright. There therefore is limited action publishers can take.
